Judicial Crisis Network Launches New Ad Campaign Exposing Potential Obama Supreme Court Nominee Judge Jane Kelly

Severino: “Her Disturbing Background is More Evidence Obama Wants a Court Dominated by Liberal Extremists.”

WASHINGTON – The Judicial Crisis Network today launched a six-figure television and digital advertising campaign in several states exposing potential Supreme Court nominee, U.S. Circuit Court Judge Jane Kelly, as a liberal extremist – another reason why, in a highly charged political climate with the country divided, the people should have a voice in deciding the next justice in their votes for the next president.
“Jane Kelly’s extreme arguments on behalf of a child predator are just one example of why President Obama should not deny the American people a voice in the selection of the next Supreme Court justice,” said Carrie Severino, chief counsel and policy director for the Judicial Crisis Network and former law clerk for Justice Clarence Thomas. “Her disturbing background is more evidence Obama wants a court dominated by liberal extremists.”
Judge Kelly is one of the potential nominees who the White House is reportedly vetting to fill the vacancy in the Supreme Court. The White House has signaled that a nominee will be named soon. Judicial Crisis Network’s Carrie Severino outlined concerns about Judge Jane Kelly’s record in a recent National Review column.
This is just the next phase of JCN’s national campaign to educate and inform the public about what’s at stake in filling the Supreme Court vacancy left by the passing of Justice Antonin Scalia.  Republican Senators, including Senate Judiciary Committee Chairman Chuck Grassley of Iowa, have rightly stood firm on the side of the American people, offering them a say in this decision through their votes for president – whoever that may be.  In addition to running the ad in Iowa, it will also appear during Sunday morning public affairs shows in Colorado, Indiana, North Dakota, Washington D.C. and West Virginia, as JCN is encouraging Senate Democrats such as Michael Bennett (D-Colo.), Mike Donnelly (D-Ind.), Heidi Heitkamp (D-N.D.) and Joe Manchin (D-W.Va.) to support giving the American people a voice in this decision.

JANE KELLY & THE CASEY FREDERIKSEN CASE

Jane Kelly Helped Obtain A Plea Deal For Child Molester Casey Frederiksen On Child Pornography Charges. Kelly Argued On Behalf Of His Release From Jail, Saying He Was Not A Threat To Society. It Was Later Proven That Frederiksen Had Sexually Assaulted And Killed A 5-Year-Old Girl Living With Him.

In October 2005, Casey Frederiksen Was Indicted By A Federal Grand Jury On Charges Of Knowingly Possessing Child Pornography. “Thursday, a federal grand jury indicted Frederiksen, 26, on one charge of knowingly possessing pornography depicting minors on a computer hard drive. The U.S. Postal Inspection Service arrested Frederiksen Thursday in New Hampton.” (Jessica Miller, “Frederiksen Arraigned On Federal Pornography Charges,” The Courier, 10/7/05)

  • In 1992, Frederiksen Admitted That He Had Sexually Molested A Girl When He Was 13 Years Old. “Casey Frederiksen was convicted as a juvenile of sexually molesting a girl, a federal prosecutor said Monday. … In arguing that Frederiksen should remain in jail, prosecutors told the judge Monday that Frederiksen admitted to Charles City police in 1992, when he was 13, that he had sexually molested a girl.” (Madelaine Jerousek, “Frederiksen To Remain In Custody Before Trial,” Des Moines Register, 10/4/05)

Jane Kelly, Frederiksen’s Lawyer, Argued He Was “Not A Threat To Society.” “Frederiksen’s attorney, Assistant Public Federal Defender Jane Kelly, argued her client was not a threat to society. She said Frederiksen had been seeing a psychologist, who said that Frederiksen was not a danger to others.” (Madelaine Jerousek, “Frederiksen To Remain In Custody Before Trial,” Des Moines Register, 10/4/05)

  • Kelly Urged The Federal Magistrate To “Look At The Way [Frederiksen] Has Lived His Adult Life And Take That More Seriously” Than His Prior Molestation Crimes. “In 1992, Frederiksen admitted to Charles City police that he had repeatedly molested a girl, Berry said, but didn’t say how old the girl was or what her relationship was to Frederiksen.  Federal public defender Jane Kelly asked the magistrate to consider Frederiksen ‘s young age then and ‘look at the way he has lived his adult life and take that more seriously.’” (Dorothy de Souza Guedes, “1,000 Images Of Porn Found,” The Gazette, 10/4/05)
  • In October 2005, Kelly Asked The Magistrate To Release Frederiksen To Live With His Father. “Jane Kelly , a federal public defender, said Frederiksen has been seeing a psychiatrist for the past six to eight weeks, who concluded Frederiksen is not a danger. She asked Jarvey to release Frederiksen to live with his father in Charles City.” (Jessica Miller, “Computer Contained 1,000 Images, Frederiksen Remains In Federal Custody,” Waterloo-Cedar Falls Courier, 10/4/05)

Kelly Helped Frederiksen Obtain A Plea Deal On The Child Pornography Charges In Early 2006. “A Charles City man who helped raise 5-year-old Evelyn Miller, whose July slaying remains unsolved, has been offered a plea agreement in a child pornography case. Casey Frederiksen, 26, was indicted last fall on child pornography charges for allegedly receiving and possessing computer images of children engaging in sexual conduct. … Frederiksen’s lawyer, Jane Kelly, a public defender based in Cedar Rapids, asked the U.S. District Court for the Northern District of Iowa for a week’s extension in filing pretrial motions, pushing back the deadline from Monday to Feb. 13. ‘It is possible there may not be a need to file any pretrial motions once counsel has had the opportunity to go over the plea agreement with Mr. Frederiksen,’ Kelly said in court documents. She said she needs time to travel to West Union to meet in person with Frederiksen at the Fayette County Jail.” (Jennifer Jacobs, “Man Offered Plea Agreement In Porn Case,” Des Moines Register, 2/1/06)
Just Months Before Kelly Had Urged The Judge To Release Frederiksen Because He Was “Not A Threat To Society,” Frederiksen Sexually Assaulted And Murdered A 5-Year-Old Girl
In July 2005, Noel Miller Returned Home From Work To Find Her Daughter, Evelyn Miller, Was Missing. “On a July morning in 2005, Noel Miller came home from working the night shift at an Iowa nursing home. She told police she arrived around 6:20 a.m. and discovered that her 5-year-old daughter, Evelyn, was missing. Everyone else was fast asleep.” (Alexis Weed and Rupa Mikkilineni, “Police Are Confident They’ll Find Girl’s Killer,” CNN, 7/22/09)

  • After A Six-Day Search With “Some 1,500 Volunteers,” Evelyn Miller Was Found Floating In The Cedar River. “Some 1,500 volunteers joined the six-day search for Evelyn Miller, but it ended tragically. The little girl was found floating in the Cedar River near rural Floyd, Iowa.” (Alexis Weed and Rupa Mikkilineni, “Police Are Confident They’ll Find Girl’s Killer,” CNN, 7/22/09)

“An Autopsy Showed Evelyn Died Of Sharp Force Injuries Including Wounds To The Neck. There Was Also Evidence Of Sexual Assault.” (Kelly Maricle, “Charges Filed: Evelyn Miller Murder Case,” WHO-TV, 9/27/12)
At The Time Of Evelyn Miller’s Disappearance, Frederiksen, Who Was Noel’s Fiance, Had Been Caring For Evelyn And The Two Children He Shared With Noel. “He had been caring for Evelyn and the two children he shared with her mother Noel, while Noel was working. Frederiksen, who was the fiancé of Evelyn’s mother and living with them at the time of her disappearance.” (Kelly Maricle, “Charges Filed: Evelyn Miller Murder Case,” WHO-TV, 9/27/12)
In 2012, The Iowa Division Of Criminal Investigation Filed First-Degree Murder Charges And First-Degree Sexual Assault Charges Against Frederiksen Connected To The Death Of Miller. “Officials say 33-year-old Casey Frederiksen has been charged with first degree murder and first degree sexual abuse in the case. Evelyn disappeared from her Floyd home on July 1st, 2005. Her body was found five days later along the Cedar River. Her death was ruled a homicide. An autopsy showed Evelyn died of sharp force injuries including wounds to the neck. There was also evidence of sexual assault.” (Kelly Maricle, “Charges Filed: Evelyn Miller Murder Case,” WHO-TV, 9/27/12)
Frederiksen Admitted To Committing Sexual Acts On Evelyn And Said He “Was Sexually Aroused When Changing Evelyn’s Diapers.” “Frederiksen admitted committing sexual acts on Evelyn, which Carter during his testimony described in explicit detail. Frederiksen also told Sullivan he was sexually aroused when changing Evelyn’s diapers.” (Dennis Magee, “Frederiksen Found Guilty Of Murder, Sexual Abuse,” Globe Gazette, 3/10/15)
In 2015, Frederiksen Was Found Guilty Of The Murder And Sex Abuse Charges And Ordered To Serve Life In Prison With No Possibility Of Parole. “Jurors late Tuesday afternoon found Casey Frederiksen guilty of first-degree murder and first-degree sexual abuse. His sentencing will be May 11 in Charles City, but the result is already known. Frederiksen will be ordered to serve life in prison with no possibility of parole. ‘Today is the culmination of 10 years of hard work and steadfast resolve on the part of all the investigators and the prosecutorial team involved in this verdict,’ said Linda Christie, Evelyn’s grandmother.” (Dennis Magee, “Frederiksen Found Guilty Of Murder, Sexual Abuse,” Globe Gazette, 3/10/15)
