Thumbs-Down on Obama’s Empathy Standard for SCOTUS

PHILADELPHIA, PA: President Obama’s “empathy” standard is widely rejected by most Americans according to recent polling. With Judge Sotomayor’s predisposition to “empathy” and judicial activism, President Obama and his nominee for the Supreme Court run against the mainstream.
The polling results are produced by IBD/TIPP, recognized for producing the most accurate Presidential Election polling in 2008.
According to IDB/TIPP, three in five (59%) believe a high court justice should consider only the Constitution, applicable laws and precedents rather than all of these plus his or her own life experiences and views. Only one in three (32%) say justices must consider their life experiences and personal views.
“President Obama’s standard for choosing a Supreme Court Justice is out of touch with the American people,” said Pennsylvania Judicial Network spokesperson Athan Koutsiouroumbas.
“Almost 60% believe that a judge should only read the law, not make their own law,” said Koutsiouroumbas, “Less than one third believes empathy is the most important factor when choosing a Justice.”
Widely perceived as an activist jurist, Judge Sotomayor’s judicial philosophy does not fall within the mainstream beliefs of Americans.
“It is essential for Senators Specter and Casey to ask Judge Sotomayor the tough questions about her activist judicial record and its impact on Pennsylvanians,” said Koutsiouroumbas, “We urge Pennsylvanians to ensure that our Senators properly scrutinize Judge Sotomayor’s record.”
